Are benefits provided in the event of the death of a civil servant? Who is eligible for benefits and how much?
THE AMOUNT AND BASIS OF PAYMENT IN CASE OF DEATH OF A CIVIL SERVANT
In accordance with paragraph 5 of Article 24 of the Law of the Republic of Kazakhstan “On Public Service”, in the event of the death of a civil servant, members of his family are paid a one-time allowance in the amount of 3 average monthly wages at the last place of service in a state body, while the amount of the allowance cannot be lower than that established by law Republic of Kazakhstan. Paragraph 3-1 of Article 6 of the Law of the Republic of Kazakhstan “On State Social Benefits for Disability, Loss of a Survivor and Age in the Republic of Kazakhstan” provides for a lump-sum payment for burial in the event of death to a family member or person who performed the burial, in the amount of 15.7 monthly calculation index.
WHO IS ELIGIBLE FOR BENEFITS?
A literal interpretation of the specified norm of laws leads to the conclusion that the specified allowance is paid to any family member , regardless of cohabitation with a civil servant, in contrast to the cases specified by other norms of the law. For example, paragraph 3 of Article 24 of the Law “On Public Service” states that civil servants and members of their families living together with them, in accordance with the established procedure, use medical care in the relevant public health institutions. In this case, the law clearly limits the circle of persons who own a certain right.
